Yohanes Konda is a Senior Partner and Head of Competition and Dispute Resolution at LAWHILL. In this capacity, Konda is involved in several of major competition and dispute resolutions as a lead partner in all higher courts on disputes ranging from general contract to company law, tax, banking law, M & A, constructions, intellectual property and other antitrust matters. He has also undertaken cases before the Tax Revenue Appeals Board and Tribunal, the Fair Competition Commission and Tribunal and as a Counsel in numerous arbitrations and expert determinations.
Konda is also involved in advisory assignments regarding electronic communication services and competition issues in Tanzania including merger and acquisition and fair practices, cross border transactions and regulatory compliance.

Experience
- Advising and representing Longping Agriscience Tanzania Limited in various contract and compliance matters.
- Successfully conducted due diligence and advised Yuan Longping Agriscience High-Tech Co. Limited to acquire Longping Agriscience Tanzania Limited.
- Involved in advising NBC Bank in respect of Multi-Currency Medium Term Notes Program (MTN) to the public.
- Advising and representing Mirambo Mining Limited, Intra Energy Tanzania Limited and Intra Energy Corporation at the Fair Competition and the Fair Competition Tribunal against the National Development Corporation for the M & A worth USD 5 Million.
- Involved in providing tax advices to Vodacom Tanzania PLC on complex commercial arrangements in respect of corporate tax, withholding tax, valued added tax, and excise duty implications.
- Successfully involved in representing Vodacom Tanzania PLC in closing numerous tax controversies worthy more than $200m (involving corporate income taxes; value added tax; excise duty; withholding taxes and Transfer Pricing adjustments) before the Tanzania Revenue Authority, Tax Revenue Appeals Board, Tax Revenue Appeals Tribunal, and the Court of Appeal of Tanzania.
- Involved in conducting legal and tax due diligence of Smile Communications Tanzania Limited and advised Vodacom Tanzania PLC it its acquisition of 100% issued share capital. The transaction involved the sale of Smile Telecoms Holdings Limited and Smile Telecoms IP Limited shares in Smile Communications Tanzania Limited to Vodacom Tanzania PLC.
- Involved in advising and representing NCBA Bank Tanzania Limited in closing its all its open tax controversies for various years, and successfully mitigated the tax exposures from more than TZS 15b to only TZS 1.9b, consequently assisted the Bank to report remarkable success for the year of income 2023.
- Advising and successfully representing Bayport Finance Services (T) Limited in its Transfer Pricing, PAYE and SDL controversies before the Tax Revenue Appeals Board and Tax Revenue Appeals Tribunal, where, both the Board and Tribunal ruled in the company’s favour in all the disputes worthy TZS 16.5b.
